Jury convicted him and sentenced him to life 11-1 but the judge increased the penalty to execution.

Words he mumbled as he was dying.

As of 2025 Smith could not be sentenced to death under current rules as the conviction by the jury was not unanimous. Further, judges were banned from overriding juries in Alabama in 2017.
