Saifullah Khan is an Afghan-American man. Mr Khan was born in a refugee camp in 1994 after his family fled the Taliban. He later moved to the United States with his family. After graduating from high school Mr Khan was accepted in to Yale University to study neuroscience.[1][2]
On 1 November 2015 Mr Khan was falsely accused of rape by a woman who's name has not been publicly disclosed. On 9 November 2015 he was banned from campus. In February 2018 Mr Khan went to trial. After a two week trial the jury found in not-guilty after deliberating for three hours.[3][4][5][6]
Later in 2018 Mr Khan was readmitted to Yale but was refused on-campus housing.[7][8]
On 5 October 2018 the Yale Daily News published another allegation of sexual assault by Mr Khan, this time from a man. Mr Khan was again banned from campus however we was permitted to attend a hearing about the 2015 accusation. He was not however permitted to be in the room while his accuser was questioned nor was his attorney permitted to speak. Further Mr Kran was denied a transcript of the hearing. Mr Khan was subsequently expelled.[9][10][11][12]
Mr Khan sued Yale university and the 2015 accuser under Title IX.[13][14]
The Supreme Court of Connecticut has previously held that accusers in sexual assault cases in judicial or quasi-judicial hearings has absolute immunity from defamation. Mr Khan was able to argue that this did not apply in this case as Yale University is not a public institution.[15][16]
Judge Kari A. Dooley of the US District Court over-ruled this on appeal, however the original judgement was restored by the 2nd U.S. Circuit Court of Appeals.[17][18]
